TERMS AND CONDITIONS OF SERVICE

SCHEDULING & RESCHEDULING

We require a minimum of 24 hours notice for all photography services. As such, last minute requests for any and all media services will be addressed individually and as available. When scheduling an appointment, please include the desired date, time, the listing address and any other important information about the property (e.g. lockbox info, pets present in the home, tenant occupancy, etc.) After both parties have agreed on a date and time, the appointment will be considered “booked” with email and or text appointment confirmation. Any specific media requests and or property/listing specifics shall be notified and mentioned in the order form prior to booking to ensure accuracy in our media capture, (e.g., don’t capture the laundry room, get a photo of the garage, fire pit, etc). Re-shoots/re-visits to the listing will be booked and billed in addition to the original booking & scope of work. Please use our “Home Preparation Guide” to ensure the home is photo and/or video ready. All properties will be shot “as is”. Any appointments that need to be rescheduled must be confirmed and booked for a new date no later than the originally booked date to be considered as a “rescheduled” booking. If they are not rescheduled and booked they will be considered a cancellation and subject to our cancellation policy.

 

WEATHER

In the case of inclement weather, (rain, snow, & excessive wind) certain conditions will not allow us to fly & capture aerial/drone. In this case, a return visit will be scheduled on the next good weather day, (which is usually the following day, sometimes later the same day) or as soon as weather permits. A member of our team will be in contact with the listing realtor to arrange with their client to ensure property is prepared, (e.g., no vehicles in the driveway etc). All other associated listing media, (interior photo, video, floor plans etc) will be captured and delivered as normal. Updated aerial/drone will be added to existing media and delivered as soon as possible. Rescheduling due to weather will be subject to current availability. 

 

TRAVEL

We are happy to provide media services for properties located outside of our normal service area, (30km radius from Barrie, ON) A travel fee may be charged for properties outside of the city limits, (refer to our service area map) either by a flat fee or by a KM distance rate of $0.60/km. We widthold the right to modify the final invoice in order to reflect the KM actually travelled to the shoot location, even if it is different from the travel distance initially quoted.

 

AT THE SHOOT

The client, homeowner, or an authorized representative should be present during the shoot. If no representative is present, our interpretation of the property will be deemed “acceptable”. We will make a reasonable effort to exclude unwanted or unsightly objects while shooting each room/space, however, this does not include actions such as moving dishes, making beds, decluttering or moving furniture without the homeowner or realtor present. Your input is important when deciding which rooms will be photographed and the best angles for each room. It is understood that without your input, we will photograph the property at our discretion, using our experience and judgment to ensure appointments are kept on time to accommodate other appointments that day. Lockbox and or home access credential and or instructions must be provided if the client, agent or homeowner will not be present at the time of the appointment. If said home access info is not provided before the scheduled appt time, a rescheduling or cancellation fee may apply.

 

PHOTO RELEASE/CONSENT

By booking a shoot, and hiring us to shoot a proprty, individual, group, or project, you hereby grant JacksonHouse Media implied consent to capture the property in it's entirety, as well as any people, tradesmen, contractors, animals that are present in the space we are capturing. This implied consent assumes that we can also share any images and videos that contain said people, animals, tradesmen, contractors, agents, employees, etc on any of our online platforms and or/ print.

 

AFTER THE SHOOT

After the initial shoot, we backup, save your files, digitally process and organize the images. This can include compositing, basic colour correction, retouching and preparing jpeg web files videos and floor plans etc for final delivery. Advanced retouching or additional revisions beyond the original scope of work is available for an additional cost.

 

DELIVERY

Real estate photos and video will be delivered within one business day (24hrs) of the photoshoot. Bookings scheduled Fridays will be delivered Monday mornings. Any shoots scheduled the day before a holiday will be delivered the day following the holiday. If the holiday falls on a Friday, media will be delivered Monday. If the holiday falls on a Monday, your media will be delivered Tuesday. 

We provide two sets of images: the first is optimized & sized for MLS, and the second set suitable for *small print, (feature books, brochures etc). Expedited delivery (rush order) is available for an additional cost. Once photos are delivered, they will remain available for downloads on your media manager account until the listing has been sold or removed from the market. It is the sole responsibility of the person to whom the photos are delivered to, to download and save their media within this listing period to avoid losing access to cloud stored media. A re-upload/archival fee will apply for access to files beyond the active listing period of complimentary cloud storage. Custom content for any clientele outside of real estate will be delivered within the agreed upon timeline per individual project per client.

 

CANCELLATION/HOME ACCESS & LATE FEES

Please note, a cancellation fee of $100 will be charged for any shoot cancelled within (less than) 24 hours of a “booked” appointment. If a cancellation is made after travel has been incurred, the cancellation fee of $100 plus a $0.60 per km charge will be billed. If the client, homeowner or representative is not available or hasn't provided access to the home during the allotted shooting time, we will consider it a cancellation and also charge a non refundable $100 fee with $0.60/km incurred. 

 If access to the listing is delayed, (realtor/home owner is late) we will do our best to capture everything required to fulfill the listing order within the remaining time, but must respect any other bookings following. If a return visit is required, this will be required to be booked and billed separately from the original order on a mutually agreed date with availability.

 

RIGHTS, OWNERSHIP, COPYRIGHT & USAGE  

All media (photo video etc) created by JacksonHouse Media remain the sole property of the photographer/media provider/creator, JacksonHouse Media (A.K.A Zachary Jackson) and carries a per-listing/per project/per-client license which is available during the active listing period and or project. The images may be used for all marketing associated with the current sale of the property in accordance with local MLS rules, including the associated realtors social media and website. Any usage of said media by a third party including but not limited to architects, builders, designers, rental properties, sellers, buyers and or realtors is prohibited and requires an additional license, unless approved in writing by the photographer/media provider/creator. Images, videos, files cannot be modified in any way, (cropping, re-use, virtual staging etc) without the written consent of JacksonHouse Media. If the media is delivered to a client with an incorported business in which the media was created for, the lisence for rights and usage remains with the corportaion/company, and cannot be used by the individual client for other associated businesses without permission. 

 

PAYMENT

All bookings require a booking deposit. This deposit is non-refundable.

Balance of invoices/orders must be made in order to receive and download all deliverable media files. Image and video files will be available to preview and proof will be provided.. We accept credit cards, e-transfers, cheques or cash. Payment options are available and listed through our online invoicing. Any media that is downloaded/screenshot/copied or otherwise used in web or print format, (website, MLS, social media etc) without receiving payment may be considered intellectual property theft and be subject to copyright infringement and licensing fees.
